One of three decisions yesterday with an unusual mix of of conservative and liberal justices.

All three of which went against things that the President likely would have favored. (Struck down gerrymandering; federal and state prosecutions for the same crime don’t violate Double Jeopardy; and upholding Virginia ban on uranium mining)
 
I wonder if they didn’t intentionally publish those oddly-mixed rulings as the first of the coming bunch and the more expected 5-4s are up next.

In case anyone isn't a glutton for punishment and reading Justice Thomas's concurring/dissenting opinions the last few terms, he is gunning to overturn Roe v. Wade/PP v. Casey.

It's mind-boggling that this Court refuses to take one of the same sex marriage cases and vote 9-0 against the bigots. It's that easy a case, but due to the horrific, dangerous and moronic Hobby Lobby Decision this group doesn't have moral compass to do the right thing.

If you’re referring to the wedding cake case, it’s not that easy and the Court remanded the Decision back to the 6th Circuit to consider the arguments in light of the CO wedding cake case, which was not released at the time of the instant case.
 
 
It really is the Biden/Schumer Rule.

Schumer said in June or July 2007 that the Senate should not confirm any of Bush’s SCOTUS picks because it was too close to the presidential election. That seems a little too far out from the election for me, but that was his position.

And it’s pretty obvious the Rule only applies when the presidency and senate are controlled by different parties. This is still politics after all.

Why would he have a problem with it? Junebug has been pretty honest about his desire for a conservative court above all else since RJ’s rib gave birth to this site.
