Nike doesn't fuck around. Avenatti threatened them by phone yesterday morning and he was arrested the very next day.

Indictments filed in Southern District of NY include extortion, conspiracy and interstate communications with intent to extort.

So, yeah, its real.

At trial (or even before trial), everything is likely to be made public, but generally, the underlying truth of the information that the extorter was using to demand payment is not a defense to extortion.

If you know your neighbor is beating his wife and kids and if you threaten to go to the police with that knowledge unless he pays you $100K, you are still guilty of extortion even if he really was beating his wife and kids.

IOW, if the allegations are true, Avenatti should be locked up for being stupid, among other reasons.

I think the question is - does your neighbor still get in trouble for beating his wife and kids. Or more specifically, if he was going public that Nike was paying kids to go to Duke and UNC, do they all still get in trouble?
