The Supreme Court handed down an order Tuesday evening that makes no sense.

It is not at all clear what the Biden administration is supposed to do in order to comply with the Court’s decision in Biden v. Texas. That decision suggests that the Department of Homeland Security committed some legal violation when it rescinded a Trump-era immigration policy, but it does not identify what that violation is. And it forces the administration to engage in sensitive negotiations with at least one foreign government without specifying what it needs to secure in those negotiations.

One of the most foundational principles of court decisions involving foreign policy is that judges should be extraordinarily reluctant to mess around with foreign affairs. The decision in Texas defies this principle, fundamentally reshaping the balance of power between judges and elected officials in the process.

The central issue in Texas is the Biden administration’s decision to terminate former President Donald Trump’s “Remain in Mexico” policy, which required many asylum seekers arriving at the United States’ southern border to stay in Mexico while they awaited a hearing on their asylum claim. Although the policy was formally ended under Biden, it hasn’t been in effect since March 2020, when the federal government imposed heightened restrictions on border crossings due to Covid-19.

well because they're risking everything to go by boat from Haiti to Mexico then to the US border, perhaps they don't have the same opportunities to get vaccinated as so many of your fellow conservatives do and ignore? might seem fit that we have the capacity here to vaccinate them better than back home.

Same as it always is, a person must show that they are a person who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of their home country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion, or in such special circumstances as the President may specify.

All people have a right to ask for asylum, regardless of how one enters the country.

Those who are fleeing Haiti because of the recent political unrest may qualify for asylum, but those fleeing from natural disaster do not. However, under law, it is their right to be afforded a chance to make their case. The Trump policies of MPP (which Biden tried to end, but was reinstated by District Judge Matthew J. Kacsmaryk, a Trump appointee in Amarillo) and Title 42 (which Biden has continued and not even considered repealing) create a very dangerous situation for those seeking asylum.

However, it is within the rights of the President and the Secretary of Homeland Security to extend Temporary Protected Status or humanitarian parole to these Haitians which would allow them entrance into the country, the ability to apply for work authorization, but would not give them permanent status - TPS is temporary, and can be renewed at the discretion of the president.

So you're saying there is a special asylum status to get into the US.

To be fair, Haitians had a special temporary asylum option for 5 years following the 2010 devastating earthquake that Obama extended for another few years and then I can remember who the next president was was but he let it expire for some reason.

Not really - and this is splitting hairs - but that was TPS (and was re-instituted by Biden for 18 more months last may). The difference in TPS and asylum (well, one of the differences) is that TPS only applies to those already residing in the country, not those wishing to enter it.
