the official new supreme court thread - Very political

Even if the Dems take the Senate, will Manchin and Sinema allow us to make a counter move? To expand statehood or pack the court?

We're thinking too far ahead as is, but if 49 Democratic senators are behind it including Mark Kelly who won AZ by 8 points or more, yeah Sinema is probably on board.

Statehood for DC and PR is just the right thing to do for representation. They make up over 1% of the population and have no representation at all. They deserve to have the same senate representation as WY, VT, etc.

Important note about PR. They have an Republican governor now (unelected) and they've had Republican governors in the past. And if they got two senate seats, Republicans would put more money, efforts, and maybe even person votes into PR. It think it's presumptious to say it would be automatic two seats.

I said this four years ago and I'll say it again. I don't think we can just assume a GOP Senate would approve a Dem nomination regardless of the timing.

Forget Manchin and Sinema, we can't even get Dianne Feinstein onboard to get rid of the filibuster.

One of the disadvantages of having your party led by a gerontocracy is that many of these people are from another era. They're not willing to fight because they can't (or won't) see that the ground rules have changed. Some, like Sanders or Warren may see it, but a good many others won't.

Completely agree. That's one of the biggest problems with the Democratic Party. The party olds have been scared of the "Reagan Revolution" for 40 years. Younger generations see the Republican Party for the chumps they are.
 
After some thought on this over the weekend, i have pretty much concluded that the whole argument about whether it is hypocritical or not is beside the point. All politicians are hypocrites, of greater or larger degree. The bottom line is that in some alternative universe where Dems got the Senate in 2018 and impeached Trump and Pence and Pelosi was the president running for reelection against Don Jr. right now, Dems would absolutely no question be ramming through RBG's liberal replacement. The SCOTUS and appeals courts as currently structured are a to the victor go the spoils political tool. Pubs have understood this for a generation; some Dems may have understood it but wanted to pretend not to. The GOP is going to be completely ruthless in filling these seats whenever they can and if Dems want the courts to uphold their legislative priorities, they better learn to play the game better.

If we as a nation want the court to truly be a lofty nonpartisan neutral arbiter (which, given human nature, is probably an impossible goal), the whole system of how we get SCOTUS justices has got to be scrapped and re-done.

And if that happens, surely center and Pop and others will blame the GOP for putting themselves in this situation.

So many trump voters pretend they are being "forced" to vote trump because... ??... oh yeah... dems are bad!
 
If Biden wins and dems get the senate, then Breyer needs to retire on Jan 21st.

This is a stater of the obvious but it all comes down to who controls the senate and the Dems have not controlled it since 2012. That's kind of amazing because even in 2010 they had a brief super majority of 60. As with the electoral college these states like Wyoming, SD, Idaho, ND, etc. where less than a million folks live gives the Pubs automatically 2 senators right off the bat. If Biden wins and Dems get senate, the first thing I do is abolish the filibuster (which should have been done years ago), then make DC and Puerto Rico states giving Dems 4 new senators. After that you can worry about packing court or expanding healthcare.
 
I absolutely loathe the GOP leadership for their hypocrisy in pushing this appointment. I understand that the so-called GOP "base" wants to undo Roe v. Wade. the last time the high court had a majority of justices appointed by democrats was 1969! So, in 1973 Justice Blackmun authors the decision, and he was appointed by Nixon. the bottom line is that Republican-appointed justices haven't overturned Roe, despite having the majority to do so.
 
Getting rid of abortion would be a disaster the likes of Prohibition.
 
Republicans have had plenty of opportunities to overturn Roe. They recognize that it's more valuable to leave Roe standing to turn out voters than to save millions of babies.
