Should Trump, Rudy and Junior be charged with murder?

Given there are reports about him being happy about the attack on the Capitol until the media and others slammed him, couldn't that show "depraved indifference" to what would happen and thus make him culpable?

If one person was going to be charged with inciting the imminent violence I feel like Rudy's "trial by combat" line was especially bad.
 
They were all conspirators. Junior said "fight for Trump". Daddy said "go to the Capitol".

Maybe we should let a DC federal court decide.
 
Why don't we just arrest them for the crimes they have actually committed? Seems easier.
 
By having these available, they might plead guilty to the others to avoid a longer sentence.
 
The most important piece will be what happened with the national guard. I hope they Benghazi the fuck out of that.
 
Talked to my same friend who was a PD in DC about this (asking if it would be possible to charge multiple of these terrorists with the murder of the USCP officer). His response was that the list of predicate felonies for felony murder in DC is extremely limited. Based on this, his short answer was basically, "Sure, they could theoretically be charged but no prosecutor would pursue that, and they would almost definitely not be convicted". Same thinking applies to Trump and Rudy.
 
Trump should be forced to live in the Big Brother house for the rest of 2021 with 19 of his most ardent supporters that stormed the Capitol.

It's worth noting that the NYT has a story on its front page that the DOJ is considering pursuing charges against Trump and others for inciting a riot, which itself is a felony (Class D, I think).

No, because he needs to have been actively engaged in a predicate felony as defined by DC and charged with that predicate felony. Withholding National Guard support wouldn't qualify under any of the predicate felonies for felony murder in DC. Obligatory NAL.
