You only get federally prosecuted if one of two conditions are met: (1) you commit a crime against an entity that has a vested interest in your prosecution and readily collects readily digestible evidence [think bank that has cameras everywhere and has a pipeline to the federal authorities], or (2) someone snitches on you. Federal cases snitch at a roughly 1:6 rate, with a slight skew higher in drug offenses. This is due to the punishments being so high, and the ease of burning another person without much retribution.

I do not know what leads to a state prosecution, but I have a feeling it's (1) and (2) above with also (3) committing a crime in front of a police officer who is forced to not ignore that you have committed a crime in front of him.

I imagine state cops just like federal cops - LOATH to do anything that requires paperwork unless (A) they really wanna fuck the guy up because the guy has fucked them in the past, or (B) someone made it really easy on them.

Big believer in this method. 1-10 is unnecessary.
