all the sites i just looked up listed dachshunds as the most aggressive breed, but their small size/stature makes them fairly non-threatening to people over the age of 4.

Pit bulls have been at the top of fatal bites since the 80's though, and their style of bite of makes them much more dangerous rather than their size. But I wouldn't go around saying Dobermans and Rotties are the sweetest dogs ever either.

What makes a dog dangerous is poor training and having its reproductive organs.

He never gave us our deposit back. When asked about it, he sends us an email saying he will countersue for $19,100 (just looked it up and almost $5000 more than I was even thinking).

His claims were ridiculous:

$500 to change locks
$2000 professional maid service
$3000 carpet replacement
$5000 new hardwood floors
$4500 shower replacement
$2600 stove replacement

Changing locks is his legal obligation. The professional maid service he hired was actually him and his gf cleaning for 2 hours. And according to the guys that currently live there and moved in less than 12 hours after we moved out, none of those replacements or things had ever been done.

I know that we would win the case but none of us (4 of us) want to deal with getting a lawyer, having this be on our minds, etc.

Definitely won't argue with the second point. I think over 90% of fatal pit bull attacks are from un-neutered male dogs.
 
7 dobermans and they all slept in the bed with me.

Unfortunately, yes. Do you advise any differently? If we continued...

Best case: Tomorrow during court we are awarded our full security deposit back ($1050 a person). He then files a new counter suit against us for damages to the place. We then have to hire a lawyer and fight him in court on all of his claims. Could go on for months. Might involve some time missed from work. Huge headache.

Worst case: $19,100 loss.

Giving into him definitely sucks but I think it's the smart play.
 
Well you're definitely not going to lose 19k, and I don't really think the discovery would be that much. I mean there aren't many contracts/facts from the sounds of it. How much proof would he have for the counter suit?

I beg to differ. I have scars from our dachshund. I have family members and a husband that is afraid of that dog.

Yeah but I'm not even trying to come from a legal perspective, just pointing out that if what Nonny is saying is true in the first place and they really didn't do anything wrong I don't see how they could lose close to 20k.
 
I don't advise one way or the other. I will say that if I weren't starting a job in two weeks I would do my best to waive into DC and represent y'all for free.

I fucking hate scumbag landlords like that.
