Maryland vs ACC lawsuit able to proceed

Seems like a small firm to be handling such a big case.

A lot of wake connections though.
 
Maryland is about to be the East Coast's University of Colorado. A school in a conference with half of a geographical rival and irrelevant revenue sports.

Well without the nice campus or anybody looking forward to visiting there.

I know of at least one firm that passed on being considered for the work. Also, its not easy to find a significant NC law firm that doesn't have a partner or two on the BOT or otherwise heavily involved with the Deacon Club or equivalent at WFU/UNC/Duke/NCSU.
 
This whole thing is so sad. Just make MD pay $20-40mm and call it a night.
 
In all my years taking civil cases to trial in Guilford County, I have never seen the lawyers that signed that Counterclaim even darken the halls of the courthouse.

Their Counterclaim is a joke and has zero chance. Typical Maryland.

Agree. Maryland is desperately trying to entice the ACC into settling the case for less than the $50 million. This counterclaim is ridiculous.

I would say, however, that the weakest part of the ACC's case is the claim that damages amount to the $50 million, when the ACC was able to recruit Louisville to replace Maryland and actually got a more lucrative TV contract that remains in effect despite the Maryland exit. The ACC is claiming that the exit fee was established by the league by-laws, but it looks more like punitive damages than actual losses due to breach of contract.

But do they need to establish the damages? They have already agreed contractually to what the damages would be...

NC law does not allow liquidated damages to be a penalty. LDs have to be related in some way to actual damages that might be sustained. That doesn't mean that the fact Louisville was added and the TV money increased is outcome determinative. You have to look to the time when the K was entered.

ACC has a decent or better shot.

The reason he had a gun was because he was a law enforcement guy. He had some connection with the team, hence his great seats.

I was in the upper deck on the other side. I saw all the commotion, but did not know what had happened until later.

I don't remember what year but would guess the late 90's to early 00's. Can't be that hard to find.

Don't open that crack. If you do then others can argue and tie up the league in years should they decide to go elsewhere.

Honestly, I believe this case is more about buyers remorse for Maryland. The ACC is stronger than ever now, without them. They seemed to think they were the keystone that would topple the league and provide the Big 10 with more Northeast schools.

Now they are stuck with a brutal travel schedule for all sports, not just football and in the end the money is likely a wash.
