If trump gets elected I think will go completely off the rocker. He will feel validated by being elected and will spent 4 years being petty and going after every perceived slight he has experienced.
He will be validated by idiots, morAns, racists, and insurrectionists.

This is exactly what should happen, which is why I’m skeptical the current court will take it up on an expedited basis.
 
I dunno, kavanaugh seems like a douche that wants to have a legacy (it won't be what he thinks/wants) and I don't think he would feel beholden at all. The religion zealots might even get on board over the objections of the republican zealots.

Yep, have to assume this is a last ditch effort to accomplish something before Trump is elected. Feels desperate considering the makeup of the court.

I would take a different view. The Trump position is that the president has absolute immunity to do whatever he/she wants to do. That means the court system would have no jurisdiction. To back that position, the SCOTUS would be giving a lot of its current power to the sitting POTUS.

The three liberals won't go for the "absolute immunity" position. Roberts won't cede judicial power to any president. IMHO, Kavanaugh and probably Gorsuch follow Robert's lead on this issue. Barrett may as well, attempting to remove some of the Trump stench from herself.

The bet is that Robert's wants to make his mark as Chief Justice. This is his opportunity. He needs one of the other five conservatives to back him, because the three liberals will be against "absolute presidential immunity forever."

Judge Chutkan's opinion is a document written for the SCOTUS. If enough Justices agree with her, all the necessary reasoning and references are right there for easy reading.

Easiest would be to declare trumps actions fell within the scope of presidential duties and responsibilities. It would be a stretch in light of the circuit court's earlier finding with respect to (lack of) presidential immunity from civil suits.

By going directly to SCOTUS, Smith removes the risk that a weird draw of three circuit court judges find in favor of Trump and gives SCOTUS an easy way of avoiding ruling.
 
Yeah I guess I'm just a skeptic, worried that it just allows them to consider taking it up then drag it out, ultimately decide not to rule, or give conflicting rulings on immunity versus double jeopardy or whatever.

I guess it's good they agreed to consider it so quickly. But I'm not convinced Thomas won't be in on whatever strategy Trump's lawyers go with.
