This continued refusal to acknowledge positive developments for Trump is a disturbing pathology. Just because Trump is a subject of investigation does not mean he cannot become a target. Moreover, Mueller — as expected — indicated he will prepare a report on his investigation. This is a positive development for Trump. What it shows, however, is that Trump’s status has not changed but neither has the status of much of the coverage. Many media commentators clearly are stuck on denial and are a long way from acceptance in dealing with the legal status of Donald Trump.

The same could be said of a lot of our lefty posters, sad.

I don't see any way Trump sits down with Mueller given how paranoid he is in general. But it does play well for him that he is supposedly considering it.

The little feltching crew we have on our board here has come a long way since Benghazi and email servers. Holy shit man

Oh so Trump is a "subject" of the investigation but not yet a "target" so he is absolved of all wrongdoing? Great hot take.

The Post Reports:

Special counsel Robert S. Mueller III informed President Trump’s attorneys last month that he is continuing to investigate the president but does not consider him a criminal target at this point, according to three people familiar with the discussions.

In private negotiations in early March about a possible presidential interview, Mueller described Trump as a subject of his investigation into Russia’s interference in the 2016 election. Prosecutors view someone as a subject when that person has engaged in conduct that is under investigation but there is not sufficient evidence to bring charges.

The special counsel also told Trump’s lawyers that he is preparing a report about the president’s actions while in office and potential obstruction of justice, according to two people with knowledge of the conversations.

Mueller reiterated the need to interview Trump — both to understand whether he had any corrupt intent to thwart the Russia investigation and to complete this portion of his probe, the people said.

In other words, he is under investigation. On the way out the door after an interview with Mueller, he could be informed that he has just become a target. In other words, the “subject but not a target” designation is at best for Trump meaningless and at worst a sign he’s in jeopardy at any moment of becoming a target. There is a further complication here. Under the Justice Department’s current Office of Legal Counsel memo, a sitting president cannot be indicted; in other words, he cannot be charged — hence is not a target — until he leaves office. Jed Shugerman of the Fordham University School of Law agrees that, most likely, “all it means is Mueller probably has no intention of indicting a sitting president (who thus is not a target).”

The most frightening news for Trump (if he was paying attention) is confirmation that Mueller will write out a report, even before his full investigation is complete, likely making the case that Trump has obstructed justice. That could then be made public by Deputy Attorney General Rod J. Rosenstein and used by Congress — in all likelihood only if Democrats win one or both chambers — to commence impeachment proceedings.

Every place I’ve looked (half a dozen or so) in the last 24 hours seems to be accurately stating “subject” not “target”. And making what seems a decent effort to explain and analyze what this means and doesn’t mean.

Seems to me that to date he’s of a similar status (subject of investigation not criminal target) to the smart lady he kept inciting folks to lock up.

What is it with rjk’s prison gay sex/rape obsession?

Not sure but he has made deragotory comment after deragatory comment regarding gay sex and gay people in general. Could be homophobia or just an old man from a sad time.

The biggest scoop out of the Post story was that Mueller is planning a report on obstruction. I don’t think he does that if he absolves Trump. He likely can’t charge him but that doesn’t mean he can’t write a report suggesting impeachment (which the GOP will ignore).

Rob Rosenstein recommended the firing of Comey. Then he appoints his friend Mueller to investigate a crime that does not exist, collusion. And when predictably nothing is found, he helps Mueller investigate obstruction by Trump for firing Comey on the recommendation of Rosenstein. This is the pile of crap the dems and the lefty media are trying to peddle on the public. What a joke.
