Here is the table for the relationship between alcohol level and the risk of a crash from the article above.
Note that the crash risk at 0.08 (not accumulated risk > 0.08) is around 4 times that of no alcohol.
There seems to be a steady increase in risk, not a sudden jump at 0.12 as suggested above.

Man, it should be illegal to drive at .00. Time for a mandatory .01 baseline!
 
Also, some state laws actual infer that someone is NOT impaired below 0.05% (corresponding to a non statistical increase in crash risk) and presume impairment at 0.08% as crash risk increases dramatically. There is even a push to increase penalties past 0.15% as some have suggested here.

I do think a sliding scale for penalties is a good idea. The argument about single car crashes not being as significant is silly though. Just because you didn't kill someone doesn't mean that no damage was done to property. Obviously not as severe as killing someone, but not victimless.
