Guess I missed something. Can someone elaborate.
 
As part of the agreement, the NBA is delaying the draft and allowing people to declare for this year's draft until Oct. 17. One of the reasons has used for getting a waiver from sitting out is that he wasn't told about the firing of DFL until after the date for declaring for the NBA draft had passed.

It is no longer an issue. Thus, his excuse has no merit and his transfer waiver should not be granted.
