Trump Not Allowed on Colorado, Maine Ballots

This, or more likely, saying the Colorado court didn't use "proper criteria" to determine that Trump was an insurrectionist. Sending it back with "better instructions" on determining whether or not Trump was an insurrectionist. In the meantime, Trump is on the ballot.
 
It will be interesting to see how that square making insurrectionists eligible to run for President but not 32 year olds or naturalized citizens or two term presidents. The Constitution is clear about this.

Will they say it was only about that one insurrection that one time and it doesn’t apply to other insurrections?

I don't think they are going to say that Sec 3 of the 14th Amendment isn’t self-executing, since virtually all of the other parts of the reconstruction amendments are, but I have definitely been wrong on predictions on what this SCOTUS will do before. As much as I personally think this should be clear, from a legal perspective, there's a lot of issues that are questions of first impression (does Sec 3 apply to POTUS, is the POTUS oath an oath to support the constitution, self-execution, what is an insurrection, what kind of proof do you need of an insurrection for purposes of Sec 3, etc.) and really not crystal clear (as opposed to a 32 year old or a naturalized citizen or a president who has served 2 terms). The due process concern is the one that strikes me as the strongest argument. I know there was a full trial in Colorado and the court found that there was an insurrection by clear and convincing evidence, but I could see SCOTUS saying some kind of higher standard (a full criminal trial? beyond a reasonable doubt?) is required.
 
Requiring a full criminal trial and conviction should be difficult to swallow for those who follow the "originalist" and "textualist" methods of interpretation.

Military personnel and civil servants all take an oath upon entry. Most of those who left to join the Confederacy were never tried for insurrection or anything else. Yet they were barred from the military or other federal government jobs.
 
Great. Now the door is wide open for this to become a regular weaponization of SecStates in future elections. Needs to be removal at the federal level, which it won't be.

No I do not think Democrat candidates will attempt an insurrection. I think Republicans are better at winning local and state elections (see school board shenanigans) and will absolutely push candidates that threaten to remove democrats from the ballot for whatever reasons they can think of. I do not underestimate their ability to do shady shit.

When the rules were established, the Maine Secretary of State would have been ruling on the qualifications of the people from Maine to be on the ballot to serve as Presidential Electors. Those voted to be Presidential Electors were entrusted by the people of their state to vote for eligible presidential candidates.

Pubs will absolutely accuse Dems of insurrection and remove them from the ballot. Give it a few weeks and we’ll start seeing news that Hunter Biden tried to over throw the 2016 election and so Joe is ineligible. He’ll be off the Idaho, Oklahoma, Alabama and the Dakotas ballots by March.

"Seeing what happened in Colorado makes me think—except we believe in democracy in Texas—maybe we should take Joe Biden off the ballot in Texas for allowing eight million people to cross the border since he's been president disrupting our state," Patrick said.
 
i mean republicans will huff and puff about taking Biden off the state ballot but they have no leg to stand on...give it a shot. they LOVE to waste a lot of money on investigations and procedures and get absolutely nothing out of them.
