Unless the employee is seriously obese, so much so that the obesity could be considered a disability, there are no federal employment laws that protect fat people. Even for the seriously obese, there is no way that an employer can legitimately avoid the ADA simply by calling a waitress an "actor." Hooters may try, but if you know someone who was denied a job on that basis you should tell them to talk with an employment lawyer.

But don't AASAC guidelines suggest that some BFOQ attributes are subject to GDOC requirements as well (specifically for acting/casting as opposed to say hiring faculty at a religious institution)? I don't know the case law off hand, but precedent extends back at least as far as when the EEOC was headed by LBJ.
