It also simultaneously says too little and too much. On the one hand, in some respects, of course slaveowners still run this country. The structure of our government was designed by them. Separation of powers, enumerated powers, bicameralism, etc. are still features of our government, and none of these features have anything to do with slavery. On the other hand, of course slaveowners don’t still run the country. The Civil War Amendments abolished slavery about 150 years ago. Originalism doesn’t look to the original meaning of the constitutional provisions governing slavery, because those provisions no longer apply. Instead, when interpreting the original meaning of the Civil War Amendments, it looks to the original meaning of those amendments, the framers of which were decidedly not slaveowners.

So Ph’s statement is a nice soundbite, but it doesn’t withstand scrutiny. All he is really saying is that our republic was founded by slaveowners, which is something everyone knows.

Originalism, based on my understanding, has two distinct interpretive trajectories. The first is as Ph describes. The second is as you describe. In practice, critics frequently note that originalists alternate between the two types depending on their ideal ends.
 
Its interesting to note the Civil War Amendments because well we had a Civil War which kind of shows that maybe the constitution was severely flawed from the beginning, since once again it was written and 75 years later we had a civil war.

also they forgot to put in things like freedom of speech, freedom of the press, search and seizure, etc in the first go at it

As I posted on another thread, the Supreme Court itself has delayed hearings and "cleared its calendar for April" due to the coronavirus. Yet apparently it's perfectly OK to force voters in Wisconsin to congregate to vote. The justices are safe and quarantined, but if you want to vote, it's do so at your own risk.

Republicans and “conservative” judges are basically a cancer.


Only the brainwashed (reality challenged) or malevolent deplorables can vote Republican at this point, imo.
 
Imagine what these guys are going do to civil rights and workers rights when given the chance.
