This Court’s use of the shadow docket is appalling.
Can Democrats please run on a Republicans are against Clean Water platform? This is a layup.
They’ll just say they are “for” clean water…just that gub’mint regulations ‘r bad…and their dimwitted voters will nod at such sagacity.
Any doubt the supreme court will declare Trump the winner regardless of the votes?
Literally the only thing most Trumpites care about it is: does it make liberals mad? If it does they're all for it, even if the rivers, lakes, and creeks near them turn into sewers from companies dumping their waste into them - much like they did before the Clean Water Act was passed.
They're basically making public policy from the bench, but unlike Congress which has public debates and committee hearings they're just doing it in secret. It makes a complete mockery of the GOP claim that their side doesn't believe in or practice judicial activism - of course they do, and this only proves it. It's also precisely what many people feared with this right-wing supermajority - they would overturn decades of liberal policies and rulings that protect the environment, and gut the ability of government agencies (like the EPA) to do their jobs. The court gutted the powers of the Federal Elections Commission to regulate campaign funding in Citizens United, it now appears that they're out to finish the job with other government agencies they hate. And with the shadow docket they can do it on the sly, in the shadows, with no hearings, no debates, and no accountability.
They will be back in November to lecture everyone on lessons the Democratic party needs to learn, blah blah.
