Fired FBI director James Comey plans to testify publicly in the Senate as early as next week to confirm bombshell accusations that President Donald Trump pressured him to end his investigation into a top Trump aide's ties to Russia, a source close to the issue said Wednesday.

I'll go ahead and get out ahead of the arguments:

@plama - "fake news"
@sailor - "sources aren't credible"
@jhmd - "oh, now Comey is worth talking to, what about the Clinton's, and two parent households"
@BKF - "This type of entitlement from Comey is what you get when you attend an elite institution"

No moonz prediction?

Doesn't him testifying rule out Mueller pursuing obstruction charges? This is bad news for Trump but it's the best bad news he could hope for.

No, it just puts him under oath and on the record with respect to subject matter that could be used in a criminal prosecution/impeachment proceeding.

1) Comey has obviously visited with Mueller to discuss his putative testimony and has been given the green light to discuss certain matters under oath.

2) Trump can't be criminally prosecuted while he's president. It's up to Congress to impeach him for obstruction of justice.

That's not quite accurate. The question of whether or not a sitting president can be prosecuted while in office has never really come up in an actual case. The closest we got was US v. Nixon, where the special prosecutor thought Nixon might not be able to be prosecuted, but Nixon resigned and Ford pardoned Nixon before it ever became an actual issue. That's not to say that the Supreme Court might eventually rule that way, but it's still an open question as of now.

What cannot happen is that Trump cannot be detained/arrested in a manner that would render him incapable of executing the duties of the President.

I've read a fair amount regarding the issue. There's a split of opinion, but many legal experts seem to suggest he could be prosecuted after he's left office, but not while he's a sitting president. The logic, in addition to the express language of the constituition, being that a single prosecutor/grand jury shouldn't be permitted to entagle a sitting president and therefore prevent him from fulfilling the duties of his office. It's for the congress, a body of national import, to remove him for crimes committed while in office.

eta: but to your point, it's never been done and is therefore still an open question

WILL NEVER HAPPEN

UNLESS COMEY WANTS TO BE INDICTED

Moonz the OG snowflake

you are some kind of lawyer

you think comey was obstructed and did nothing about it? He certainly did not testify about it when he had the chance and actually testified as to no pressure or interference.
