Listened to the arguments this morning. My prediction is they declare the mandate unconstitutional; but sever it and say the rest of the law stands. I would bet the liberal wing plus Roberts state the whole law should stand. Maybe one or two of Thomas, Alito and/or Barrett declare the whole law unconstitutional. I’d guess it’s 7-2 for it to remain minus the mandate.

I haven't heard anything about Gorsuch. What did you hear from him?

Alito surprised me as much as (maybe more) than Kavanaugh.

If it stands, I hope Biden works out a way to allow people of all ages to buy into Medicare. This will take some really high end math to portion out old age contributions from current contributions for all ages. Doing this will drive costs down massively while giving more care. This is by far the best, most efficient and most cost effective way to transition to universal healthcare.

If companies can save 20-30% on healthcare costs, they will do it in a heartbeat.
 
I think I predicted somewhere on here they’d strike the mandate but allow its severability.


If so, that’s better than striking the whole thing for sure.

But still unfortunate.

We really need a system everyone is part of—that we all reasonably contribute to in a progressive fashion and that’s there to meet our needs if/when they arise.

Still wasn't / am not confident good will prevail, but always important to remember lawyers love to think of themselves as following the law somehow divorced from the real world.
 
According to NBC' Supreme Court Reporter, Pete Williams, from the questions asked at the hearing today, it looks like killing ACA in its entirety is unlikely. Roberts and, shockingly, Kavanaugh asked questions that strongly supported allowing ACA to stand. Even Alito asked questions and made statements that made it appear he might side with keeping ACA by saying Congress had the chance to void the entire law but chose not to do that.

I am incredibly, pleasantly surprised and hopeful. Pete Williams seemed to interpret this morning's proceedings very positively.

Our Chief Legal Officer, a former Obama adviser, has been bullish the law stands at least 6-3 or 7-2. Roberts pretty much nailed it....If Congress wanted to kill the whole law, they could have, but they didn't. They just ended the tax. At this point, striking the mandate isn't meaningful at all. The law only works because of the subsidies.

No, we're listening to what Trump said about why he was nominating certain people on the Supreme Court. He proudly stated his main goal was to overturn ACA through the courts.

No, we are listening to Republicans in the House and Senate who have been trying to get rid of ACA from the day after Obama signed it.

No, we are listening to dozens of Republican governors and state houses.

For most of the part decade, Republicans have said getting rid of ACA was second only to getting rid of Obama himself.

To say it was "Dem scare tactics" is to have been deaf and blind for the past decade.

I understand there will be a lot moving parts to making this concept a reality, but can Biden legally create and enforce an Executive Order to lower or totally eliminate the age requirement for Medicare?

Lots of things are "baked" into laws EOs address. Even things like changing environmental changes or DACA or other things.

Obviously, this wouldn't be just saying you can buy into Medicare at 35, but can it be done if the EO has the infrastructure built into it?

I'd be be fairly surprised if CH's company hasn't already figured out what to do if the age is dropped to 55 as has been proposed. Of course, I say why stop at 55.

Am I missing something? Didn't Kavanaugh (the bold and wicked) indicate yesterday that he is leaning on not supporting the repeal of the ACA?

I was referencing the individual mandate, which all the conservative justices will say is unconstitutional, despite it a. not being unconstitutional, and b. being a Heritage Foundation conservative idea. So, yes, as usual you are missing something. Try to keep up.
 
Although my positions have moved even a little farther to the left than they were, some now consider me almost a Republican.

BTW, the chart about being for or against M4A and GND impacting winning or losing as a Dem is total bullshit. It doesn't factor in that AOC, Omar and others ran in 95+% Dem districts versus those who lost having run in 50/50 or maybe even ones that had been GOP.

Numbers without accurate context are meaningless. That chart proved nothing.
 
Biden should prepare an Executive Order stripping Trump, Jared, Barr, Ivanka, Don. Jr., Pompeo and the new yahoos put in place this week of their security clearances. It could be one line and a list.
