the official new supreme court thread - Very political

Why does it seem like originalists love everything about the constitution including enslaving people?

Looks like they’re taking a stab at overturning Brown. Can’t have legal desegregation without a legal process to desegregate. If institutions don’t have to take affirmative steps to desegregate, de facto segregation becomes legal. It’s easy for any institution to justify it. They can just say the Blacks and Hispanics are too dumb and the powers that he will accept it.

A reminder that Stephen Breyer is 82 years old and should have retired the day Biden took office. You want to guess which Party is going to eventually nominate his replacement?

Pretty sure it’s ageist to say old people in politically pivotal jobs should retire when it’s politically expedient to do so and not whenever they want. And it’s certainly ageist to call them selfish for doing so.

Not everyone shares the passion of the Tunnel's left for race-based discrimination. This terrible idea has been on borrowed time for a while now. Time's up.

I’m ok with that. Breyer’s old ass should retire during a Democratic term if he doesn’t want to die during a Republican term. There’s far more at stake in the world than the feelings of a few 80 year old judges.

Or we could stop judging people based on their race. I think that's a good idea. Why don't you?

Your rhetorical bullshit is transparent. No one is being “judged” by affirmative action. The US was undeniably segregationist in the past and certain minorities were structurally denied opportunities, and now we are trying to insure that those minorities groups are provided opportunities.

You can whine and bitch all you want, racism was a collectivist problem (Black Americans are victimized as a group) and it requires collectivist solution. This individualist “not every black person needs affirmative action, you are judging them waah waah” bullshit is dumb, and no one is buying it.

You guys will rationalize anything. Using race as a factor in public opportunities is racial discrimination. You can spin it all you want but that's what it is and you are in favor of it. Add it to your resume. It's not as bad as abortion but it's still pretty bad, and history will be unkind.

You think you can get away without fixing the problem of racism. You can’t wish it away, you can’t close your eyes and plug your ears and pretend it never happened. It happened - it’s happening. This nation owes Black people. Literally and figuratively. We owe them reparations, we owe them for violence done against them, we owe them for property stolen from them and opportunities denied them. For you to deny that is asinine.

“If you stick a knife in my back nine inches and pull it out six inches, there's no progress. If you pull it all the way out that's not progress. Progress is healing the wound that the blow made. And they haven't even pulled the knife out much less heal the wound. They won't even admit the knife is there.”

right? no one buys it. I'm guessing he doesn't really buy it deep in his heart, but you know it makes him feel so much better to ignore the uncomfortable past and maintain that he is all about equality and fairness NOW. Jim Crow laws are off the books and whatnot, its fine. The more we talk about all that bad stuff, the worse HE feels and gets confused about how to make it better without any more tax money coming out of HIS account, or HIS kids not getting the best possible head start in life like he had.
