Days before Mar-a-Lago subpoena, Trump lawyer claimed she scoured Trump's office, closets and drawers

Just six days before the Justice Department subpoenaed to recover highly sensitive documents housed at Mar-a-Lago, one of Former President Donald Trump’s attorneys scoured the estate searching for records in response to a separate legal matter.

The attorney, Alina Habba, told a New York State court that on May 5, she conducted a search of Trump’s private residence and office at Mar-a-Lago that was so “diligent” it included “all desks, drawers, nightstands, dressers, closets, etc.” She was looking for records in response to a subpoena issued by New York Attorney General Letitia James, who is investigating matters related to the Trump Organization.

The filing submitted to the New York AG’s office raises key questions in relation to the separate Mar-a-Lago probe, chiefly, whether Habba ended up handling any of the documents that DOJ later discovered at Trump’s club; and, if so, whether she has the clearance to have done so. In her sworn affidavit, Habba said that she searched many of the locations that would later be scrutinized by the FBI during its Aug. 8 search of Mar-a-Lago — and where investigators say they uncovered a significant volume of highly classified government secrets. The documents, those investigators stated, “had colored cover sheets indicating their classification status” making clear their significance.
 
So why hasn't she been charged already? She blatantly lied in a sworn affidavit.
 
Alright, Trump called for Hillary to be prosecuted and put in jail for mismanaging confidential information. Trump wasn't even at Mar-a-Lago and these documents were just laying on the ground. Prosecute Trump.

Docs weren't just laying out on the ground. They were put on the ground by the FBI to be photographed. Otherwise, absolutely agree. Dude needs to die in jail.

I don't think this has been confirmed. And if it was the FBI, it makes no sense why they would place a Bankers Box of framed magazine covers next to them for the photograph, unless that was just an innocent bystander.
 
It has nothing to do with that. No court/prosecutor in the country would bring charges against an attorney for representations they made in a filing the day a photo comes out.

Not a lawyer, but this filing was separate from the classified documents. So it's possible (though given everything else, seems unlikely?) that she didn't find anything related to that subpoena. But she would have had to dig through a lot of classified documents to complete her search.

This is the DOJ filing from last night: "That the FBI, in a matter of hours, recovered twice as many documents with classification markings as the 'diligent search' that the former President's counsel and other representatives had weeks to perform calls into serious question the representations made in the June 3 certification and casts doubt on the extent of cooperation in this matter," DOJ wrote.

Who would have filed charges against the attorney sometime in the last 3 weeks? She said she performed a diligent search. She's probably a hack and didn't do that because everyone associated with Trump is a hack. But can you say without question right now that Trump didn't hide documents from her or didn't tell her where to look?

"calling into question" is really the most the DOJ can say at this point. That said, I'm sure tomorrow's hearing is going to be really uncomfortable for Trump's attorney.

Pretty certain this is confirmed and standard practice. The fact that this is Trump's big new defense is just said, and he implicated himself by admitting they took the docs out of cartons - admitted they were there and not planted and admitted he knew where they were.
