He shouldn't. This is completely on the cops. They're more concerned with protecting themselves and serving their own interests.

In a rare case in which someone should have unloaded before going to the bathroom, a Kentucky man was shot in the leg Sunday when he place his loaded handgun on the toilet paper dispenser at the Elizabethtown Fazoli’s restaurant. The man told police that the gun slipped off of the dispenser and fell to the floor, where it discharged, hitting the man in the leg. He was taken to the hospital, and is expected to recover fully.
