How does the federal government not have jurisdiction over lands that the federal government owns?

There are three types of criminal jurisdiction: exclusive, concurrent and proprietary. Extensive body of law on topic.

In the case of "proprietary" jurisdiction, the federal government is essentially just the landowner. Other for crimes AGAINST the government, they're not the sovereign for routine criminal matters.
 
If only the judicial branch would stop sitting idly by and rule on the matter of the cows grazing.

Take your herd of goats or chickens to the nearest federal building to graze on the landscaping and find out how little substantive, actual difference there is between proprietary and criminal jurisdiction.

I feel like this happened in New Hampshire a few years ago. Some crazy old white guy didn't believe in the Federal Government so didn't pay taxes. Ended up owing millions in back taxes from his successful dental practice, refused to pay because why pay something to an organization you believe shouldn't exist. He was charged with a bunch of crimes where his defense was there are no laws that exist that he has to pay federal taxes and even if they did he doesn't recognize them. Surprise he was convicted but then returned to his crazy militia compound in the mountains of New Hampshire where he had a standoff with federal marshals. The crazy train arrived and a bunch of other people joined him to stand up to the feds.

The Browns got 5 years for not paying their taxes, but 35 years for the ruckus surrounding their nonsense. Maybe Bundy goes out in a hail of bullets, but at his age (mid-70s?) he's effectively looking at life in prison. The Negro/slave talk won't make him real popular in the big house.

Saw something on 60 Minutes awhile back on sovereign citizens. There's way too much twisted "logic" to refuse to recognize the federal government (currency? interstate highways?), but still be a believer in the second amendment. Their estimated number was 300K. Some loopy retired General claimed he was asked to lead an armed militia of 250K on DC. Bundy's crew of supporters in Nevada is estimated at 1000 to 1500.

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people." There are plenty of people who wish that it didn't say that and have turned growing wheat in your backyard to interstate commerce, but finding any ambiguity or leeway there is reading a nonexistent exception into a pretty clear rule of specific limitation to enumerated powers. What you're talking about is an end run around the Amendment process by deployment of the phantom nuance.

The language of the tenth amendment isn't very helpful in determining what powers are delegated to the federal government by the constitution, it just says what happens to the powers that are not delegated.

I'm not well versed in the history surrounding the 10th amendment but nothing in the language indicates a specific limitation to enumerated powers.

What I don't get is how anyone ever supported this guy. Forget about his racism. He grazed his cattle on land at an agreed upon price for years and years. Then he refused to pay.

According for former MT Gov. Brian Schweitzer, people routinely pay $12/head/month. This guy's price was $1.35/head/month.

This is a scumbag. No one on any side can possibly justify his actions. Yet Hannity, Rand Paul and many others tried.

He was a welching thief. He was taken to court and lost. When he refused to pay, a lien was put on his herd. This is basic, SOP procedure. There was never an excuse to support him.

I mean it says powers not delegated in the Constitution are reserved to the states. That phrase is just a synonym for enumerated. If it's "not delegated in the Constitution" then it's an unenumerated right

Yeah...again I completely agree with RJ on this matter. He never had a point so it's a total cop out to say "well now that he's spouting racist hatred I see him for what he really is."

I'm no lawyer but leaving this word out changes the interpretation significantly, no?
