New York legalizes gay marriage

Presently there are 22 states and the District of Columbia that have enacted laws that ban employment discrimination based solely on a person’s sexual orientation. Although, each state’s laws are different each one provides some basic protection from being fired or terminated for being gay. The states that have such laws are: California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, Ohio, Nevada, New Hampshire, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Washington, and Wisconsin.



Some employers have enacted their own policies against sexual orientation discrimination. Some of these policies voluntary and some was enacted through negotiations with unions. If you live in a state that does not have laws providing protection but if the employer have a policy against sexual orientation discrimination and the policy is violate then the victim may have some legal recourse.

That wasn't the question. The question was in which states can you be fired for being gay. That is what rj said.

Sorry you aren't smart enough to figure out that you can be fired for being gay in all of the states Deacfan27 did not list. Most people on here have basic deductive reasoning skills that would make it unnecessary to list the remaining states.

So you are saying a person working in a state not listed could be called into the HR Department and be told he was being fired because he was gay? I doubt it.

Doubt it all you want. That doesn't mean its not true. Employment at will and no protected class for sexual orientation = can be fired for being gay.

Let's assume you own a widget company and pay your sales people by commission only. Your heterosexual salesman calls on a company who want to buy one million widgets. The Purchasing Agent , who is homosexual, calls you and says he wants a homosexual sales person. What would you do with the heterosexual employee?

I'll answer my own question. I would hire a homosexual to service the accout. If we worked in one of those states you listed I could be sued by the heterosexual employee for discrimination because of sexual orientation. Am I correct?
 
Unless sexual orientation is defined by statute as a protected category, the status is unprotected.

There is an emerging line of cases suggesting that discriminating against someone for failing to adhere to prevailing sex stereotypes could be a form of "discrimination because of sex." However, that line of cases falls far short of prohibiting discrimination based on sexual orientation.

I did find a story about a lawsuit that a softball team had too many heterosexual players on a team at the gay softball world series. Does that count?
